ONLINE STORE TERMS OF SALE

The owner of the Energiakaubamaja online shop (hereinafter referred to as the Online Shop) is Energiakaubamaja OÜ (registered office 16833201), located at Laki 30, Tallinn.

Validity of the sales contract, goods and price information

The terms and conditions of sale apply to the purchase of goods from the Online Shop.
The prices of the products sold inthe Online Shop are indicated with the products. Theprice is subject to a delivery charge. All prices of goods sold in the online shop are in euro.
Delivery charges depend on the location of the buyer and the delivery method. The delivery charge is displayed to the buyer when placing the order.
Information about the goods is provided on the Online Shop directly next to the goods.

Placing an order

To order, you must add the products you want to your shopping cart. In order to place an order, you must fill in the required fields and select the appropriate delivery method. The total cost of the order and the choice of payment methods will then be displayed.

It is possible to pay for the order with the following Estonian bank payments: Swedbank, SEB, Luminor, LHV, Coop Pank, Citadele, Revolut, N26
NB! When paying by bank transfer, be sure to click on the “Back to merchant” button on the bank page.

The payments are intermediated by Montonio Finance OÜ. Payments are made outside the Online Shop in a secure environment – in the case of payments by bank transfer in the secure environment of the respective bank and in the case of payments by credit card in the secure environment of Montonio Finance OÜ. The Seller does not have access to the customer’s bank and credit card details. The contract will enter into force as from the date of receipt of the amount due in the current account of the Online Shop.

The owner of the online shop is the controller of the personal data and transfers payments to. the personal data necessary for the execution of payments to the processor Montonio Finance OÜ-to.

In addition, it is possible to pay for your subscription using ESTO hire-purchase solutions.

If the goods ordered cannot be delivered due to expiry of the goods or for any other reason, the buyer will be informed as soon as possible and the money paid (including delivery costs) will be refunded immediately, but not later than 14 days after the notification.

Delivery to

Goods are shipped to the following countries: Estonia.
The buyer has the following options for picking up the goods: courier service or parcel machine.
The shipping costs of the goods are borne by the buyer and the corresponding price information is displayed in the shopping cart under shipping method. The online shop may offer free shipping, which is also indicated in the shopping cart.

Shipments within Estonia usually arrive at the destination specified by the buyer. at the latest within 5 working days from the entry into force of the sales contract.
In exceptional cases, you have the right to have the goods delivered within 45 calendar days.

Right of withdrawal

After receipt of the order, the buyer has the right to withdraw from the e-contract within 14 days.
NB! Depending on the products, the buyer may not have the right of withdrawal, in such a case, the relevant products and services must be listed and must comply with the requirements of Section 53(1) of the Law of Obligations Act.s 4 .
The right of withdrawal does not apply if the buyer is a legal person.
14-In order to benefit from the one-day right of return, the goods ordered must not be. used in any other way than that required by the nature of the goods, for the purpose of ascertaining the nature, characteristics and functioning of the goods in a manner similar to that permitted for the testing of goods in a physical shop.

If the goods have been used for a purpose other than that required by the nature of the goods, for the purpose of ascertaining the nature and functioning of the goods , or shows signs of use or wear, the Webshop has the right to reduce the refundable amount in accordance with the reduction in the value of the goods.

In order to return the goods , you must submit a withdrawal form (free form) and send it by e-mail to.info@energiakaubamaja.ee within 14 days of receipt of the goods at the latest.

The cost of returning the goods is borne by the buyer, unless the reason for the return is that the product to be returned does not correspond to the product ordered (e.g. wrong or defective product).
The buyer must return the goods within 14 days of the date of the application or provide proof that he has handed over the goods to the carrier within that period.

Upon receipt of the goods to be returned, the online shop will return to the buyer immediately, but not later than 14 days from the date of receipt of the withdrawal, all payments received from the buyer under the contract. The online shop may refuse to make refunds until it has received the return of the goods that are the subject of the contract or until the buyer has provided proof that it has returned the goods, whichever is the earlier. If the purchaser has expressly chosen a delivery method other than the cheapest delivery method offered by the Online Shop, the Online Shop is not obliged to reimburse the consumer for the cost that exceeds the cost of the usual delivery method.

The online shop has the right to withdraw from the sale and request the buyer to return the goods, if, as a result of a mistake, the price of the goods in the online shop is marked significantly below the market price of the goods.

Right to lodge a complaint

The online shop is liable for the non-conformity or defect of the goods sold to the buyer, which already existed at the moment of delivery and which will become apparent within a maximum of two years from the delivery of the goods to the buyer. Within this period of one year from the delivery of the goods to the purchaser, the defect shall be presumed to have existed at the time of delivery. It is the responsibility of the Online Shop to rebut this presumption.

The buyer has the right to contact the online shop within two months of becoming aware of the defect, by sending an e-mail to info@energiakaubamaja.ee or by telephone: (+372) 5332 0533.

The online shop is not liable for defects that occur after the goods have been delivered to the buyer.

If goods purchased from the Online Shop have defects for which the Online Shop is responsible, the Webshop will repair or replace the defective goods. If the goods cannot be repaired or replaced, the Online Shop will reimburse the purchaser for all the fees paid under the sales contract.

The online shop will respond to the consumer’s complaint in writing or in a format that can be reproduced in writing within 15 days.

Direct marketing and processing of personal data

The online shop uses the personal data provided by the buyer only to process the order and send the goods to the buyer. The online shop forwards personal data to companies providing transport services in order to deliver the goods.

The online shop will send newsletters and offers to the buyer ‘s e-mail address only if, if the buyer has expressed his wish to do so by entering his e-mail address on the website.email address on the website and indicate their wish to receive direct mail notifications.

The purchaser can opt-out of receiving offers and newsletters by email at any time by notifying us by email or by following the instructions in the email containing the offers.

Dispute resolution

If the purchaser has any complaints about the Online Shop, they should be sent by e-mail to info@energiakaubamaja.ee or by calling (+372) 5332 0533.

If the buyer and the Online Shop are unable to resolve the dispute by agreement, the buyer can refer the matter to the Consumer Disputes Committee. You can read the terms and conditions of the procedure and apply here. The Consumer Disputes Committee (CDC ) is competent to settle disputes arising out of a contract between the buyer and the Online Shop. The examination of the buyer’s complaint by the Commission is free of charge.

The buyer also has the right to refer to the European Union’s consumer dispute resolution platform.
